The terms that govern your use of our website and services

1. Agreement to these terms

These Terms & Conditions (“Terms”) govern your use of lifestonesettlements.com (the “Site”) and the services offered through it by Lifestone LS LLC (“Lifestone”, “we”, “us”). By using the Site, submitting a form, or communicating with us by phone, text or email, you agree to these Terms. If you do not agree, please do not use the Site.

2. What we do, and what we do not do

Lifestone helps policy owners explore whether selling a life insurance policy, a life settlement, makes sense for them, and connects those who wish to proceed with prospective purchasers.

3. Eligibility

The Site and our services are intended for individuals aged 18 or over, and are directed to residents of the United States. Do not submit information through the Site if you are under 18.

4. Text messaging and mobile information

Program. The Lifestone Settlements messaging programme sends account and service messages about an inquiry you have made: a representative reaching out, scheduling and rescheduling, reminders about documents we need from you, and occasional updates about your policy's estimated value.

How you opt in. You opt in by giving us your mobile number and ticking the consent box on a form on this Site, or by texting us first. The box is not pre-ticked, and consent to receive text messages is not a condition of using our services or of any purchase. You may use the Site, and speak to us by phone or email, without agreeing to texts.

Message frequency. Message frequency varies depending on your inquiry and where you are in the process.

Cost. Message and data rates may apply. We do not charge you for messages; your mobile carrier may.

How to stop. Reply STOP to any message to opt out at any time. You will receive one confirmation that you have been unsubscribed, and then no further messages. Reply HELP for assistance, or contact us using the details in section 12.

Your mobile information. Mobile information will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. We share mobile numbers only with the service providers who deliver messages on our behalf, and only for that purpose.

Delivery. Message delivery depends on your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

Changing your number. If you give up or change a mobile number you gave us, tell us promptly, so that messages intended for you do not reach someone else.

5. Calls and call recording

If you give us a phone number, you agree we may contact you at it about your inquiry.

We record calls. We record inbound and outbound calls for quality, training and accuracy of the policy information we collect. You will hear an announcement at the start of a recorded call. Florida is an all-party consent state: if you do not wish to be recorded, say so and we will stop the recording or end the call.

6. Information you give us, and HIPAA authorizations

To evaluate a policy we collect information about you, your policy and your health, and we may ask you to sign a HIPAA authorization allowing us to request records from your insurer and medical providers. You agree the information you give us is accurate and yours to provide. A HIPAA authorization is voluntary, is limited to what it states on its face, and you may revoke it as described in the authorization itself. How we handle this information is set out in our Privacy Policy.

7. Acceptable use

Do not use the Site to submit anyone else's information without their authority, to submit false information, to attempt to gain unauthorised access to our systems, or for any unlawful purpose.

8. Third-party links and services

The Site links to third-party sites and uses third-party tools for scheduling, e-signature and communications. We are not responsible for the content or practices of third parties, and their terms and privacy policies govern your use of them.

9. Disclaimers and limitation of liability

The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. To the fullest extent permitted by law, Lifestone LS LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising from your use of the Site or our services.

10. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms, the Site, or our services will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction and venue of those courts.

11. Changes to these terms

We may update these Terms. The “last updated” date above will change when we do, and the updated Terms apply from the date they are posted.
